Popular EHR vendor eClinicalWorks settled with the U.S. government for misleading users about its capabilities. This was done in part by cheating on certification tests.
The lawsuit against eClinicalWorks was brought under the False Claims Act, because along with alleging that it falsely obtained meaningful use certification, it also alleged that eClinicalWorks gave customers kickbacks for publicly promoting its products.
The settlement was $155 million.
The recent settlement raised many alarms regarding EHR vendors.
Providers are concerned about whether their certified EHRs are safe or not. There are many deficiencies within the certification program for EHRs.
What should you do to protect your PHI stored in your EHR?
If you are worried about your protected health information, make sure it is securely backed up – no matter what EHR vendor you use.
Also, make sure you have all of your contracts in order so that you don’t get locked in to an autorenewal contract with your current EHR vendor.
Finally, ask your EHR vendor about known bugs or issues.
