Healthcare and COVID Fraud

The federal government is still working on investigating fraud related to the Coronavirus Aid, Relief, and Economic Security (“CARES”) Act.

The CARES Act was a federal law that provided some financial relief to businesses during the COVID-19 pandemic. Forgivable loans were issued for rent, expenses, and payroll through the Paycheck Protection Program (“PPP”).

Recently, a chiropractor in Kansas was charged with bank fraud, money laundering and false statements for fraudulently obtaining PPP loans.

Allegedly, he received $145,800 from multiple banks.

The case is currently under investigation and the chiropractor has been indicted.

It is essential that healthcare providers are constantly monitoring their compliance with laws, especially with laws related to the COVID-19 pandemic. The government made changes to many laws and stopped enforcement of other laws for some time to alleviate pressures on healthcare entities. However, healthcare entities should be aware of recent enforcement actions.

When is the last time you audited your billing? Did you pay special attention to the codes related to COVID-19 and telehealth?

If not, now is the time to work with a healthcare attorney to do a comprehensive audit.

We recommend performing audits with the help of an experienced healthcare attorney to help remedy any concerns and put into place the necessary policies and training.

How have your office procedures changed since COVID-19? Have you taken the time to thoroughly update any related policies and procedures?

If not, now is the time.

If the government comes to do an audit, it is essential that your policies and procedures are up to date and reflect your office activities and readiness plans.

Your staff should also be trained to know how to respond in the event a government official comes to audit your office.

If you have any concerns regarding your compliance, billing, policies and procedures, or training, contact Rickard & Associates today. Now is the time to act.
